Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of ColorShelf, a tool for organizing Ohuhu marker collections, arranging markers in a physical grid, and building color palettes. By creating an account or using ColorShelf's synced features, you agree to these Terms.

You can use ColorShelf's core Collection, Organization, and Use features as a guest, without an account. Creating an account adds cross-device sync and account-backed capabilities and requires accepting these Terms and our Privacy Policy.

2. Your account

You are responsible for maintaining the security of your account and for all activity under it. Authentication is handled by our identity provider (Clerk); you agree to provide accurate information when creating an account.

You must be legally capable of entering into a binding contract in your jurisdiction to create an account.

3. Acceptable use

You agree not to: use ColorShelf for any unlawful purpose; attempt to gain unauthorized access to other users' data or to ColorShelf's systems; interfere with or disrupt the service; or reverse-engineer or scrape the service beyond normal use.

ColorShelf's marker catalog and color data are provided for personal reference in support of your own marker collection and artwork.

4. One-time Pro purchase and billing

ColorShelf offers a Free plan and a paid Pro plan. Pro is purchased with a single payment processed by Stripe; the price, currency, and included features are shown before checkout.

A completed Pro purchase grants non-expiring access to the paid ColorShelf capabilities tied to your account. It does not renew automatically and ColorShelf does not charge a monthly or annual subscription fee.

Lifetime access means access does not expire merely because time passes. It remains subject to these Terms, the continued operation of ColorShelf, account deletion, abuse or fraud controls, and payment validity. A full refund, chargeback, or finally lost payment dispute may revoke Pro access.

Refunds are provided where required by applicable law and otherwise under the refund policy presented at purchase or by support. A partial refund does not revoke Pro access unless explicitly agreed as part of that refund.

We may change the price of future Pro purchases, but a price change does not create another charge for an account that already holds active lifetime Pro access.

5. Your content

You retain ownership of the data you create in ColorShelf (your marker collection, organization preferences, and saved palettes). You grant us a limited license to store and process this data solely to operate the service for you.

If you use ColorShelf as a signed-out guest, your data is stored only in your browser and is not transmitted to our servers.

6. Termination

You may stop using ColorShelf at any time. You can request deletion of your account and associated data from the Account page's Privacy & Data section.

We may suspend or terminate access for accounts that violate these Terms, with notice where reasonably practicable.

7. Disclaimers and liability

ColorShelf is provided "as is" without warranties of any kind. Marker color representations are approximations for reference and may not perfectly match physical marker ink under all lighting and display conditions.

To the extent permitted by law, ColorShelf's liability for any claim arising from your use of the service is limited to the amount you paid us in the twelve months preceding the claim.

8. Changes to these terms

We may update these Terms from time to time. When we make substantive changes, we will update the version and effective date above, and signed-in users will be asked to review and accept the updated Terms before continuing to use authenticated features.
